A New Beginning

After meeting with favorable feedback regarding my first foray into legal writing (ssilaw.blogspot.com), this is my next contribution to the world of legal blogging. The purpose of this blog is to discuss current issues regarding Veterans Benefits, with a focus on Disability Advocacy, and to serve as a resource for those individuals who may have the need to apply for benefits thereunder. My name is Thomas O'Brien and I am a Veterans Benefits and disability attorney.

  1. I'm not sure what type off comments go here so I will try this: Title 38 CFR specifies only the sitting position for measuring knee extension/flexion. But the C@P exam given to me (and I suspect many others) used sitting, standing, and supine. QTC cherry picked the least favorable measurements (not sitting in my case), and provided the least favorable measurements to VA. I am awaiting a decision from VA to see if they are going along what I see as deliberate downgrading of Veteran's Disability ratings.
